Fast Company ? Creative Strategy Lessons from the 100 Most ...

The June 2012 issue of Fast Company highlights the magazine?s list of The 100 Most Creative People in Business 2012. I will admit to not reading all of previous Fast Company 100 Most Creative People in Business lists. This year, however, having Ceelo Green on the cover (along with Purrfect) compelled me to take a shot at reviewing the entire list in-depth for the first time.

And of course, taking the time to read the whole list necessitated coming up with a way to turn the effort into a Brainzooming blog post. My starting idea was to pick one creative inspiration from each of the 100 people and turn the creative lessons into a massive 100-item list post.

After going through and identifying the 100 creative lessons that stood out for me, however, I realized the post was about 3000 words! That is typically a week?s worth of blog posts!

A Liquid Dier to Lose Weight

Climate change allows once-rare British butterfly to thrive

Although it's well known that climate change can prompt plants and animals to shift the ranges in which they live, the brown argus (Aricia agestis) has widened its living quarters with unusual speed, according to an analysis of decades of data collected by British volunteers.

Warming in Great Britain appears to have given a little brown and orange butterfly an edge. The brown argus butterfly has spread about 49 miles (79 kilometers) northward on the island over 20 years, observations indicate.

The butterfly's secret??A new host plant to feed its larvae.

In cooler periods, the larvae feed on the rockroses growing in warm spots, mostly on southerly facing, chalky hillsides, said study researcher Jane Hill, an ecologist at the University of York.

The same butterflies living on continental Europe also feed on geraniums, but, historically, the British brown argus larvae rarely lived on these plants. Now observations collected by volunteers indicate this changed in the 1990s, when average summer temperatures reached unprecedented warmth.

Then, the brown argus butterflies began to show up more often at sites where all potential host plants were geraniums. [Butterfly Gallery: Beautiful Wings Take Flight]

A genetic mutation or physiological change in the butterflies is unlikely, Hill said, rather it appears that warmer temperatures simply allowed them to incorporate a new host plant. (The butterflies have continued using rockroses).

Once the brown argus butterflies can establish populations on their favorite geranium, called dove's-foot cranesbill, they can spread quickly among these common plants. Other dynamics, such an escape from parasites at rockrose sites, helped out, the researchers write in an article published in Friday's (May 25) issue of the journal Science.

"It is a bit of a good news story, and we don't get many of those," Hill said. The caveat, she added, is that the butterfly's range may well be retracting in parts of its range outside of England and Wales, where the observations used in this study were collected.

INDIAN CORPORATE LAW: Depreciation and Sale-and-Lease-back ...


One of the most important deductions permissible under income tax law in relation to capital assets is depreciation. Under the general scheme of the Income tax Act, particularly section 32, depreciation is allowed to an assessee who is the owner of a capital asset used for the purposes of business. The criterion of ?ownership? is given a slightly more liberal scope under tax law. Assessees can make use of this relaxed understanding in structuring their transactions so as to gain the benefit of depreciation. One such device used is that of sale and lease back transactions. Such transactions often come under the scrutiny of revenue authorities as being not genuine. In this context, the question of claim of depreciation in the case of leasing transactions assumes importance. A couple of recent decisions have provided some measure of clarity in this regard.

In IndusInd Bank v. ACIT, ITA 6566/Mum/2002, a Special Bench of the Tribunal had to consider whether depreciation would be allowed to the lessor or to the lessee. The facts were that the assessee, a bank, entered into an agreement with another company under which the assessee was lease out a boiler to the company for a specific fixed period, subject to payment of lease rent. After the expiry of the period, the asset was to be sold to the company. The assessee bank claimed depreciation on the boiler. The Assessing Officer did not accept this claim on the ground that the transaction was merely a paper transaction. At best, according to the assessing officer, the transaction could be categorized as a finance lease and not an operating lease.


The Special Bench noted that in substance, a finance lease is akin to a loan from the lessor to the lessee. After examining the decision of the Supreme Court in Asea Brown Boveri v. IFCI 54 Taxman 512 (SC), and Association of Leasing & Financial Services Companies v. Union of India , and relying on Accounting Standard ? 19, the Special Bench noted the broad features of a finance lease as under (para 5.14 of the order of the Bench):

-???????? A finance lease is non-cancelable, and there is a fixed obligation on the lessee for payment of lease rent for the period of the lease. If the lease is terminated prematurely by the lessee, the lessor is entitled to recover his investment along with expected interest.

-???????? A finance lease is always for a fixed period. This period is calculated by taking into consideration the economic life of the asset; and is settled in such a way so as to fully recover the investment of the lessor together with interest.

-???????? The lessor is interested in the recoupment of his investment with interest in
the shape of rentals over the period of lease, and not really with the asset itself or its user.

-???????? The lessee bears the responsibility of costs of insurance, repairs, maintenance etc. The features of bailment are absent. An operating lease, on the other hand, has the features of bailment. In a finance lease, the responsibility of the lessee is not restricted only to taking ?as much care as a man of ordinary prudence would? as warranted under section 151 of the Contract Act, but extends beyond this threshold.

-???????? The equipment is chosen by the lessee, but the payment to the supplier is made by the lessor. Thus, the lessee chooses the assets, takes delivery, enjoys the
use of the asset, and bears the risks and costs of its wear and tear, taxes/charges in relation to the asset etc. The risks and rewards incidental to ownership vest with the lessee and not with the lessor. The lessor simply holds the title of asset by way of security for recouping the investment and interest.

The Special Bench further noted that in the case of an operating lease, a lessor can claim depreciation; however, in the case of a finance lease, only the lessee would be entitled to claim depreciation. The Tribunal noted that even for the purposes of tax law, ?In a lease transaction also there can be only one owner of the asset, that is, either the lessor or lessee and not both of them or either of them at their discretion. Whereas in the case of operating lease, it is the lessor who is the real owner of the asset, but in case of finance lease, it is the lessee who is to be regarded as the real owner of the asset. Ex consequenti only the lessor can claim depreciation in case of an operating lease and the lessee, as to who should be conferred the benefit of deprecation allowance.?

Further examining the terms of the agreement between the parties, the Special Bench held that the lease agreement was a paper transaction to cover up the reality. The bench noted, following the decision of the Supreme Court in Sundaram Finance Limited v. State of Kerala AIR 1966 SC 1178, ?The true effect of a transaction may be determined from the terms of the agreement considered in the light of the surrounding circumstances. In each case the Court has, unless prohibited by the statute, power to go beyond the document and to determine the nature of transaction, whatever may be the form of the document??

The Delhi High court also recently considered the question of when an agreement should be considered as a finance lease and when it should be considered as an operating lease. The Court reaffirmed that the question could not be decided by merely looking at the title, nomenclature or label given to the agreement: the terms and conditions of the Agreement are relevant but not conclusive. Surrounding circumstances can look at. The court followed Sundaram Finance, which in turn had relied on the following observation of Lord Esher MR in Re Watson ??When the transaction is in truth merely a loan transaction, and the lender is to be repaid his loan and to have a security upon the goods, it will be unavailing to cloak the reality of the transaction by a sham purchase and hiring. It will be a question of fact in each case whether there is a real purchase and sale complete before the hiring agreement. If there be such a purchase and sale in fact and afterwards the goods are hired, the case is not within the Bills of Sale Act. The document itself must be looked at as part of the evidence, but it is only part, and the Court must look at the other facts and ascertain the actual truth of the case.?

At the same time, these observations must not be treated as giving complete freedom to the revenue to ignore the wording of the contract between the parties: the Madras High Court recently clarified (CIT v. M/s High Energy Batteries, T.C. 579/2005, decided on 17th April, 2012; a decision in the context of a reopening of assessment where the Revenue?s stance was that a sale and lease back transaction was not genuine), ?Given the freedom to enter into agreements with parties and guided by commercial considerations, even to invoke the theory of tax evasion, the Revenue must have sufficient material to draw an inference of what had been shown as an understanding on an agreement between the parties, is not, in fact, so.?


It is thus clear from these decisions that the distinction between operating leases and finance leases (clarified by the Supreme Court in ABB?s case) is relevant in income tax law as well, and suitable care needs to be taken in structuring transactions and drafting the agreements to avail of appropriate tax benefits.

Absinthe 2.0 Arrives to Jailbreak Apple's iOS 5.1.1

A new version of the tool used to unlock iPhones and iPads hit the Internet this week, giving daring users the ability to unlock their devices, even if they run Apple's latest iOS 5.1.1 operating system.

The software, called Absinthe 2.0, was announced Friday at the Hack in the Box security conference in Amsterdam. It allows users full access to their iPhone's and iPads through jailbreaking -- a process which removes the limitations imposed by Apple on devices running their software.

With this, users can download additional applications, extensions and themes that are unavailable through the official Apple App Store.

Speculation surrounding the release reached a tenor when the software's developers, Jailbreak Dream Team, were announced to appear at the 2012 Hack in the Box conference.

"This was certainly one of the most highly anticipated talks we've EVER had at one of our HITB conferences, and we've done quite a few of these," said Dhillon Andrew Kannabhiran, Founder and CEO of Hack In The Box. "The excitement from the Dream Team followers and overall Twitter and online buzz has been terrific!"

The software works by exploiting security holes in Apple's own operating system. Apple first released iOS in 2007 with the original iPhone and has since been updating and refining the software. The current version, 5.1.1, was released on May 15.

The developers don't expect that Apple will roll out a quick fix for the latest iOS hack.

"Of course, they are going to patch things. But I'm not sure they will release a new version of iOS just for this. I think they will wait for iOS 6," said team member Cyril, according to IDG.

In addition to the ability to jailbreak the latest operating system, Absinthe 2.0 is untethered, which is more desirable than other jailbreaks because it allows users to reboot their devices without plugging them into external computers. This means the device will remain jailbroken if the user reboots.

The software can be used on the iPhone 4S, 4 and 3GS and breaks ground being the first untethered jailbreaking solution for the latest iPad.

The team expect their latest software to be downloaded about a million times, they said during a press conference following the announcement.

Money Pros and Cons ? Personal Finance Basics

Is money good or is it bad? Depending on what way you look at it, cash can be good but it can be a bad thing as well. Money is good because it creates the opportunity for any type of lifestyle you desire. It can fund your dreams like going on vacation or could allow you to retire early. Cash provides the ability to have a family, live in the neighborhood you want and allows to you to do anything you can imagine. Smart money management is the easiest form of personal finance basics.

The down side to money is if you live for it. By slaving away at a job that you don?t enjoy to earn money makes it bad. Money misguides people enough to become workaholics and desert their friends and family.

Without question cash does have more good aspects than bad. Unfortunately the bad things related to money are often linked with misuse or greed.

What is Money to you?

Is earning boat loads of money to live anyway you want important to you or would you like to work just enough so you can kick back and enjoy a modest lifestyle. The options are easy with hardly any grey area and we all make that choice when dealing with the personal finance basics in our lives.

If you feel that working 60 hours every week so you can boot around in an expensive vehicle and live in a 3500 square foot home is the way you enjoy living then good for you. Sadly, I believe|in my opinion} you are a slave to money if you must work that much to own an expensive car and oversized home.

On the other side of the scale if you only desire all play and zero responsibility then you are a slave to yourself. Cash probably has little value to you and you make just enough to get by. Is that bad? Who am I to say.

I believe there is a happy medium when it comes to money. It?s possible to get all of the pros and none of the cons. Hard work is incredibly important but it?s good to know that you should not work for money. The more you understand personal finance basics, the more it will start to give back to you and the less likely you will be it?s slave.

The best advice I can give is to find an occupation that you truly enjoy and would love to do for free anyway. If you?re unhappy at your job its likely because you only see the how much you make at your job. The way to make money a good thing in your life is to alter the way you think and love where you are. The great thing is, the more passion you put into everything in your life, the more the money will actually flow in. In short you will work less and make more.

New Housing Trends Cater to Baby Boomers - Homes MSP Real ...

More sophisticated in their housing wants and desires than previous generations, many are preparing for their next phase of life by selling their their family homes and moving on to new experiences... or re-designing their homes to accommodate their retirement lifestyle.

The trend for Baby Boomers and?first-time homebuyers alike is to?look for small, smart homes in walkable neighborhoods. Some of the features they are looking for? are similar,?and they?are having an impact on new housing trends.

Some features the National Association of Home Builders?is seeing?Baby Boomers?are looking for include...

  • Home offices - many Boomers are continuing to work as they retire, but often in a different capacity... maybe as consultants or starting businesses of their own which they run from home
  • Tech/media centers - many in the Boomer generation are tech-savvy, and want amenities such as WI-FI, media centers, remote control lighting and security features
  • Wider doors and hallways - Boomers are thinking ahead about aging in place in their new homes... wider doors and hallways make it easier to move?in furniture now, and will accommodate wheelchairs if needed on a temporary or permanent basis in the future

  • Easy to maintain exteriors and landscaping - many Boomers are looking for relief from yard work, painting and other landscaping chores and choose to buy in a townhome or condo community where that is taken care of for you; those choosing single family homes often opt for maintenance free exteriors, smaller lawns and low maintenance landscaping... or flower beds?with easy access?for the garden enthusiast
  • Flex space - this kind of space that can be adapted for use as a guest room, office, hobby room, library as needs change?is becoming prevalent for all age groups as the trend?moves to smaller smaller, smarter spaces... reminds me of 1950's ramblers where the 'third' bedroom was often this flexible kind of space

Calcium Supplements May Increase Heart Attack Risk - Kiefit.com




An analysis of data on nearly 24,000 people followed for over a decade suggests taking calcium supplements may increase the risk of having a heart attack. This is the main finding of a study published online this week in the journal Heart that also concludes boosting overall calcium intake through dietary sources brings no significant benefit in terms of reducing risk of heart disease or stroke. The researchers say calcium supplements, which are often recommended to the elderly and women after the menopause to protect against bone thinning, should be "taken with caution"...

Concrete Pavers Can Create an Old World Look, Quality Concrete ...


Have you ever seen a paver walk or patio that has a charming worn and textured appearance that reminded you of narrow streets or large piazzas in photos of Europe (or perhaps from a visit to Europe), and thought ?where can I find a paver like that for my patio?? They are not hard to find if you know where to look.

Such a paver may be natural stone like travertine. Or it could be a paver manufactured from concrete to resemble natural stone. Manufacturers of concrete pavers have been creating pavers with great detail to reflect the rough surface or a cleft surface of the stone used long ago to pave streets, plazas, and courtyards.

Their rich color and tactile qualities can certainly enhance the visual appeal of an outdoor space.

Your Outdoor Space Has a Floor

Do you think of the walking surface of your outdoor space as the ?floor?? It actually is the floor, and we selected examples of some of these unique concrete paver styles that can give it a classic textured old world feel. These examples of paver projects are dry-laid (sand joint) installations, and typically are less expensive than mortared installations, which would require an underlying concrete slab and a skilled mason. Depending on the quality of materials that your supplier stocks, a dry-laid concrete paver project may be slightly less expensive (your cost will be effected by the paver you choose) than the same project using natural stone. If you need to get price quotes for the different materials you are thinking about using, do an apples-to-apples comparison using the same application, such as a price for dry-laid concrete pavers vs. dry-laid natural stone pavers.

Two Factors We Think are Important for You to Consider

That?s not to say there are only two factors to consider, you will have your own to consider, but we feel these are some things a homeowner may not think about beforehand:

  • A good thing to keep in mind is your walking comfort with a paver surface that is not smooth. Before you make your purchase, ask the paver supplier if a small mock up (some suppliers already have displays set up for homeowners to see what a paver field would look like)? could be set up for you so that you can walk on the paver style you are interested in, with and without shoes, to see if it meets your expectations. If you have ever walked barefoot on a seagrass rug, you?ll know why this may be something you want to consider ? some people may think a surface is too rough under foot and some won?t be bothered by it at all.
  • something else to think about is that some non-smooth paver surfaces? may be too uneven for outdoor furniture to set on -? some pavers may work better for a driveway than a patio

As you might imagine, paver projects can add value and enjoyment to your home.

Same Sex Romance and Mass Effect 3 | Border House

Though rare, same sex romance options are not new to video games. We have seen them Jade Empire, The Sims, The Elder Scrolls V: Skyrim, and the Dragon Age series. But lately, BioWare has had some shining moments in this area. When they announced that Star Wars: The Old Republic was going to add same sex romances post release The Family Research Council got members to send thousands of letters to EA to denounce the move. Before delving into Mass Effect 3, it is important to look at the series as a whole. Let?s look at what character romances result in the Paramour achievement/trophy in each game. I call those the primary romances or relationships. The original Mass Effect had had 2 primary romance options for both the male and female Shepard. As a man you could romance Ashley Williams and Liara T?Soni while as a woman you could romance Kaidan Alenko or Liara T?Soni. While Liara is often considered by fans as a same sex romance for a female Shepard, the game specifies that asari are a mono gendered species. They do not talk about a male/female gender binary; they are simply asari. So we walk away from the original Mass Effect without an official same sex romance.

Mass Effect 2 had many more romance options than the original game. As a man, Shepard could romance Miranda Lawson, Tali?Zorah, or Jack. As a woman, Shepard could romance Jacob Taylor, Garrus Vakarian, and Thane Krios. None of these are same sex options.

Mass Effect 3 has the largest number of romance options in the series. As a man, Shepard can romance Miranda Lawson, Tali?Zorah, Jack, Ashley Williams, Kelly Chambers, Liara T?Soni, Kaiden Alenko, or Steve Cortez. As a woman, Shepard can romance Garrus Valkarian, Kaidan Alenko, Kelly Chambers, Liara T?Soni, and Samantha Traynor.

However, there were also relationships that were not tracked by the Paramour achievement. In Mass Effect 2 either Shepard could show interest in Samara, Morinth, and Kelly Chambers. This last option of Kelly Chambers is the only one in Mass Effect 2 that could definitely counts as a same sex relationship option. In Mass Effect 3 either Shepard could have a sexual relationship with Diana Allers which which add another same sex relationship option for a female Shepard.

All those numbers mean something??

When looking at the numbers, there is a clear trend for greater diversity in sexual relationships within the Mass Effect series. But there is something else in those numbers: a male Shepard has more options than a female Shepard. Part of this is due to the exclusion of Thane and Jacob as romance options in Mass Effect 3. Yet, even if those two were included in the group, a female Commander Shepard would still have fewer potential romance options than a male. The quantity of options appears to favor a male Shepard.

This favoritism falls apart when discussing same sex relationships. If we look at Liara as a same sex option for female characters, then a lesbian Shepard has had a romance option since the beginning of the series. Even ignoring Liara, a lesbian Shepard could start a relationship with Kelly Chambers in the second game and then have that carry over to Mass Effect 3. BUT, a gay Shepard had to wait 3 games in order to have a possible relationship. If you choose to role play Shepard as a gay male, romance is left out until the end of the series. What could have been done differently?

Liara from Mass Effect 3

The relationship with Liara T?Soni deserves discussion. Does she ?count? as a same sex romance for a female commander Shepard or not? If she is considered female, then there is a potential for a long term same sex relationship between her and Shepard stretching from the first game through to the last. But by describing her as part of a monogendered species the series denies players one positive lesbian romance portrayal. While a relationship with a genderless species could be interesting the asari are not androgynous, they are heavily coded as feminine. Because of their appearance, the relationship looks like a same sex romance with a female Shepard but should it be read as such or should we look at it as something different? I am not sure. Even after 3 games I do not know if my Shepard?s relationship with Liara can be considered a lesbian romance.

Kelly Chambers in Mass Effect 2 is also potentially problematic. Her relationship with Shepard is not considered a canon romance in that game. It is a flirtation, a quick hint of a potential relationship. When she joins Shepard in her cabin at the end of the game she is wearing a tight fitting outfit and does a sexy dance. The point of the scene is to provide sexual arousal for Shepard but does not allow for a further relationship within that one game. There is nothing wrong with that, but as the only portrayal of a same sex relationship in Mass Effect 2 it conforms with a male gaze, ?two women are hot? portrait of lesbian relationships that is all too common in media. We need more diversity in the portrayal of lesbians. This relationship can become deeper in Mass Effect 3 but only if Shepard goes though this more superficial experience in the second game.

What makes ME3 special?

The final game in the series does several important things in terms of relationship options. The game portrays them as something that can be persistent and evolving over time. It is possible to have started a relationship with Liara in the first game, stayed faithful to her in the second game, and continue the relationship in the final episode. This is something unique and not available to a player that just wants to begin a relationship with Liara in the final game. The way the trilogy was set up allowed for the possibility a dynamic relationship. The NPCs were treated as having potential beyond just sex. These were characters whose stories mattered, with their own journey and growing relationships with Shepard.

However, one of the new characters in Mass Effect 3 is incredibly important. Steve Cortez is a pilot in the game. When discussing his past, you learn that he lost his husband in a Reaper invasion. This fact is handled wonderfully. We have a man, discussing the loss of his husband, and there is no pause in the discussion. Shepard does not stop to say, ?Whoa, hold on, are you saying you are gay?? or ask any other question all too often heard by people in same sex relationships. Cortez mentions his husband and we are meant to mourn the loss with him. It is no different than if he mentioned the loss of his wife. This one simple thing is incredibly important. Imagine a world where all players of Mass Effect 3 accepted gay individuals as easily as Shepard does in the scene. Cortez being attracted to someone of the same sex is not an issue; it is a not an oddity, it just exists as one option within the universe. Cortez is shown as an exclusively gay man, and yet his sexuality is never shown as a problem. His sexuality is not used to impose tragedy in his life. This is not the tale of a difficult coming out story or an attack on a gay man. He is allowed to be a gay man and not have that one trait define his character arc. It is not something we see very often in media. This portrayal was done beautifully.

Authorial intent

Were the writers?cognizant of these depictions and their implications? In an interview, Patrick Weekes and Dusty Everman show that members of the BioWare staff were aware of how they displayed these relationships. As Patrick Weekes said about writing a gay character:

Liara?s relationship in Lair of the Shadow Broker can be with players of either gender, so I was familiar with writing dialog that needed to work for a same-sex romance. Nevertheless, I?m a straight white male ? pretty much the living embodiment of the Patriarchy ? and I really wanted to avoid writing something that people saw and went, ?That?s a straight guy writing lesbians for other straight guys to look at.?

?I also really wanted the romance with Traynor to be positive. One of my gay friends has this kind of sad hobby in which she watches every lesbian movie she can find, trying to find ones that actually end up with the women not either dying or breaking up. I think the most positive one she?s found is ?D.E.B.S.? I wanted to avoid any kind of tragic heartbreak, to make this a fundamentally life-affirming relationship? at least, as much as possible within Mass Effect 3?s grim war story.

Samantha Traynor from Mass Effect 3

Similar to Cortez, for the exclusively lesbian character of Samantha Traynor her sexuality is a part of her but not her sole defining feature. Patrick Weekes again:

?I worked hard to create a character who addressed her lesbian identity in a positive and intelligent way. My first draft of Traynor?s pitch was all about how her character arc would be about identifying and overcoming the challenges of being gay? and my friends and managers called me on it. I?d been so focused on writing something positive that I hadn?t made a real-enough character. So in the next draft (closer to how she shipped), the focus was on her as a mostly lighthearted fish out of water, a very smart lab tech trying to adjust to life on the front lines, with her identity as a lesbian present but not shouted from the rooftops.

?I believe that by the 22nd century, declaring your gender preference will be about as profound as saying, ?I like blondes.? It will just be an accepted part of who we are. So I tried to write a meaningful human relationship that just happens to be between two men.

?This interview shows that the team at BioWare was conscious of the implications of their character designs and story arcs. They were aware of some of the pitfalls often found when creating gay characters and they at least attempted to avoid them. What do we want to see next

BioWare did several laudable things in Mass Effect 3. So what do we want to see in future games? From both BioWare and other companies I ask for one thing: DIVERSITY! We need more games to show the complexity of human experiences. Let?s have some asexual characters. Let?s have NPCs that are straight but are NOT interested in the main character despite a match in gender and orientation. Let?s have more gay characters. Once we have more diversity, we can tell more stories. The Princess doesn?t always need saving by the Prince and the Prince may not want to marry a Princess anyways. Let?s step out of the box a bit more and get creative. Who would want to play a game with a lesbian necromancer as the main character? I would! And I doubt that I am the only person. Games are meant to be fun to play, so let?s play with the stories and create some new experiences.
